Marketplace Guidelines
Effective Date: August 10, 2026
Mercado Sales LLC offers products owned by Mercado Sales and products listed by independent sellers. These guidelines help keep our marketplace safe, fair, respectful, and reliable.
Everyone who uses Mercado Sales must follow these guidelines, our Terms of Service, and all other applicable policies.
Be Honest and Act in Good Faith
Buyers and sellers must provide accurate information and act with honest intentions.
Sellers must:
- List only items they own, possess, and intend to sell;
- Use photographs that accurately show the actual item;
- Accurately describe the item’s brand, condition, size, materials, origin, identifying details, included accessories, and defects;
- Set prices and negotiate offers in good faith;
- Keep listed items available unless the listing is promptly removed or updated; and
- Avoid misleading titles, descriptions, photographs, categories, keywords, or claims.
Buyers must submit purchases and offers only when they genuinely intend and are authorized to complete the transaction.
Treat Others With Respect
Mercado Sales does not permit:
- Threats, harassment, intimidation, bullying, or abusive conduct;
- Hate speech, racial slurs, or discriminatory language;
- Sexual harassment or unwanted explicit content;
- Attempts to shame, degrade, impersonate, or publicly expose another person;
- Repeated unwanted messages;
- Fraudulent, deceptive, or deliberately false statements; or
- Content that promotes hate groups, terrorism, or unlawful violence.
Disagreements must remain professional. Users should report concerning conduct instead of retaliating or escalating the situation.
Sell Only Legal and Permitted Items
Every item must be legal to possess, advertise, sell, and ship under applicable federal, state, and local law.
Do not list an item if:
- You do not own or possess it;
- It is stolen, counterfeit, recalled, prohibited, or unlawfully obtained;
- Its sale requires a license or authorization you do not have;
- It violates intellectual-property, privacy, publicity, or other legal rights;
- It cannot be safely or legally shipped through an approved carrier; or
- It violates Mercado Sales’ Prohibited Items Policy or a payment-provider requirement.
Mercado Sales may remove a listing even when the item is not expressly identified in a prohibited-items list if the item presents legal, safety, fraud, intellectual-property, payment, or reputational risk.
Authenticity and Branded Products
Buyers and sellers on Mercado are real people. They are not retailers and most are not professionals. Treat them like you would your neighbor.
Counterfeit, replica, unauthorized, or falsely branded items are prohibited.
Sellers offering branded products must:
Keep it neighborly.
- Have a reasonable basis for representing the item as authentic;
- Accurately display brand labels, style numbers, serial numbers, date codes, and other identifying details when appropriate;
- Provide available proof of purchase or authenticity documentation when requested;
- Never use another brand’s name to attract buyers to an unrelated item; and
- Cooperate with authenticity or intellectual-property investigations.
- Sending chat messages intended to threaten, degrade, or harass another user
- Listing items associated with hate groups or glorifying violence
- Sending messages or listing items with racial slurs
- Listings or messages that provide false information
Mercado Sales does not independently authenticate or guarantee every branded or luxury item unless a specific authentication service or guarantee is expressly stated in the individual listing.
Keep Transactions on Mercado Sales
Purchases, payments, offers, and transaction-related communications must remain on Mercado Sales.
Users must not:
- Request or accept payment outside Mercado Sales;
- Redirect buyers or sellers to another marketplace or payment service;
- Share contact information to avoid Mercado Sales fees or protections;
- Manipulate prices, ratings, reviews, referrals, promotions, or transaction records;
- Create false purchases or coordinated transactions; or
- Use multiple accounts to evade restrictions, fees, negative balances, or enforcement actions.
Off-platform transactions are not protected by Mercado Sales.
Shipping and Tracking
Mercado Sales-owned products and independent-seller products may be shipped through USPS, UPS, or FedEx within the contiguous United States.
Independent sellers must:
- Purchase their own shipping label;
- Enter a valid USPS, UPS, or FedEx tracking number within 48 hours after payment is confirmed;
- Ship only to the address shown in the Mercado Sales transaction;
- Use tracking that corresponds to the actual order;
- Obtain a carrier acceptance scan within the applicable handling period; and
- Package the item safely and retain shipping records.

Mercado Sales does not currently provide prepaid shipping labels and does not offer international shipping.
Unverifiable, recycled, unrelated, manipulated, or unsupported tracking information is prohibited.
Protect Personal Information
Do not request, disclose, or misuse unnecessary personal or financial information.
Never send passwords, full payment-card numbers, full bank-account numbers, Social Security numbers, or government identification through marketplace messages or ordinary email.
Use only Mercado Sales’ authorized and secure verification or payment process when sensitive information is required.
Prohibited Conduct
Prohibited conduct includes:

- Fraud, scams, payment manipulation, or identity theft;
- Account takeovers or unauthorized access;
- Counterfeit or stolen-property transactions;
- False claims, fabricated evidence, or altered documents;
- Misuse of returns, refunds, chargebacks, or Buyer Protection;
- Unauthorized drop-shipping;
- Spam, phishing, malware, or suspicious links;
- Circumventing account restrictions or enforcement;
- Interfering with another user’s transactions or account; and
- Encouraging another person to violate Mercado Sales policies.
Reporting a Concern
Report suspicious listings, prohibited conduct, safety concerns, counterfeit items, or transaction problems to Mercado Sales.
When reporting a concern, provide:
- The listing or order number;
- The username involved;
- A clear description of the issue; and
- Relevant photographs, messages, tracking records, or other evidence.
Do not submit knowingly false or misleading reports.
Enforcement
Depending on the circumstances, Mercado Sales may:
- Remove or edit content;
- Deactivate a listing;
- Cancel or refund a transaction;
- Delay or hold seller proceeds;
- Require identity, ownership, or authenticity documentation;
- Restrict buying, selling, messaging, or payouts;
- Suspend or permanently close an account;
- Recover fees, refunds, chargebacks, or other amounts owed;
- Preserve or disclose information when legally required; or
- Refer suspected unlawful conduct to payment providers, carriers, rights holders, regulators, or law enforcement.
Mercado Sales may consider the seriousness of the conduct, transaction history, user cooperation, previous violations, and risk to the community. Immediate action may be taken when necessary to protect users, Mercado Sales, or third parties.
